{"id":7039,"date":"2021-05-03T10:31:00","date_gmt":"2021-05-03T08:31:00","guid":{"rendered":"https:\/\/merac.es\/?p=7039"},"modified":"2021-05-03T10:31:00","modified_gmt":"2021-05-03T08:31:00","slug":"venta-inmueble-65-anos-exento-renta-vitalicia","status":"publish","type":"post","link":"https:\/\/merac.es\/en\/venta-inmueble-65-anos-exento-renta-vitalicia\/","title":{"rendered":"The sale of a property when you are over 65 may be exempt from income tax if it is converted into a life annuity."},"content":{"rendered":"<p>As we have seen on other occasions, the IRPF law regulates various tax benefits for the possible capital gain generated if you sell a property when you are over 65 years of age.<\/p>\n\n\n\n<p>In previous posts we talked about the exemption that exists for the capital gain generated by the sale of the main residence by people over 65 years old, but there are some other exemptions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-exenci-n-total-por-la-venta-de-un-bien-transformado-en-renta-vitalicia\"><strong>Full exemption on the sale of an asset converted into an annuity<\/strong><\/h2>\n\n\n\n<p>Article 38 of the Personal Income Tax Act, which regulates exemptions for reinvestment of profits obtained, states in paragraph 3 that capital gains arising from the following are exempt from taxation <strong>transfer of assets<\/strong> (including real estate) carried out by <strong>taxpayers over 65 years of age, provided that the total amount obtained is intended to constitute a life annuity, and up to a maximum amount of EUR 240,000.<\/strong>.<\/p>\n\n\n\n<p>For this exemption <strong>it is not required that it is a habitual residence, not even that it is a building, it applies to any asset. <\/strong>provided that an annuity is constituted under the fulfilment of a series of requirements that we discuss below.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-requisitos-para-aplicar-la-exenci-n\"><strong>Eligibility for exemption<\/strong><\/h2>\n\n\n\n<p>In order to benefit from this exemption, a number of requirements and deadlines must be met:<\/p>\n\n\n\n<ul><li>That the <strong>total amount obtained from the transfer (<\/strong>less expenses and taxes inherent to the sale)<strong> be reinvested<\/strong> in setting up the annuity. If it is partially reinvested, the exemption is applied proportionally to the amount reinvested.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul><li>That the annuity be constituted <strong>within 6 months<\/strong> since the transmission of the item in question<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>This period is only extended for gains subject to withholding tax, so that the reinvestment of the withholding tax amount in annuities can be made until the end of the financial year following that in which the transfer takes place.<\/p>\n\n\n\n<p>Moreover, it is important to keep the 6-month period in mind because if the sale is made in instalments, the capital gain that would be deferred with the <strong>deferred payment<\/strong>if more than 6 months have elapsed since the transfer of the item, <strong>would not be exempted for this reason.<\/strong> [1]<\/p>\n\n\n\n<p><\/p>\n\n\n\n<ul><li>That the <strong>annuity contract with an insurance company<\/strong>.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul><li>The life annuity contract must necessarily state <strong>the taxpayer as beneficiary thereof<\/strong>.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul><li>The annuity must <strong>start to be paid within 1 year<\/strong> since it was set up.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul><li><strong>The periodicity of the annuity must be less than or equal to 1 year.<\/strong> and the amount may not be more than 5% lower than in the previous year.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul><li>And, it <strong>must inform the insurer<\/strong> that the annuity being taken out is <strong>reinvestment<\/strong> of the amount obtained on the transfer of the assets (for the purposes of applying the relevant exemption)<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>In any case, the <strong>The maximum amount that can be exempted for reinvestment in annuities is 240,000 euros.<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-cl-usulas-posibles-en-los-contratos-con-la-aseguradora\"><strong>Possible clauses in contracts with the insurer.<\/strong><\/h2>\n\n\n\n<p>In addition, the regulations allow annuities to include, in the event of the death of the contributor, (i) reversionary mechanisms or (ii) certain benefit periods or (iii) counter-insurance formulas.<\/p>\n\n\n\n<ul><li>The&nbsp;<strong>reversion mechanism&nbsp;<\/strong>in insurance contracts allows the insured (in this case the contributor-beneficiary) to transfer all or part of the annuity to a new beneficiary after his or her death.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul><li>Annuity insurance contracts with&nbsp;<strong>certain performance periods&nbsp;<\/strong>are those in which <strong>ensures that the rent is received, for a minimum number of years<\/strong>even if the main insured person and beneficiary had died before the expiry of this period (in which case the annuity would be received by the beneficiary designated for this purpose).<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul><li>And, the&nbsp;<strong>counterinsurance formulas&nbsp;<\/strong>(the most commonly used in insurance practice) are those that <strong>guarantee<\/strong> to the designated beneficiary <strong>a capital<\/strong> in the event of the death of the insured.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>In order to ensure that this tax benefit of exemption of the gain fulfils its initial purpose and does not become an instrument that allows property transfers without any taxation, a series of temporary or quantitative limitations have been established for those contracts that are signed after 1 April 2019 (additional provision 9) and which must meet the following additional requirements:<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>In the case of a reversionary mechanism, i.e. where the heirs are allowed to receive the amount of income not paid to the deceased beneficiary taxpayer, the Personal Income Tax Act provides that <strong>there can be only one beneficiary<\/strong> of the annuity that reverts.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>In the event that a \"...\" clause has been included in the contract.<em>certain periods of performance<\/em>\"These periods <strong>may not exceed 10 years<\/strong> since the annuity is constituted<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>And, for counter-insurance formulas, the total amount received by the beneficiary on the death of the primary beneficiary, <strong>shall be limited to certain percentages<\/strong> in respect of the amount intended to constitute the annuity.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>However, it should be recalled that these formulas are applicable in the event of the death of the beneficiary, \"once the annuity has been constituted\", and that therefore <strong>would not be<\/strong> applicable to this tax benefit <strong>if the transferor dies before entering into the annuity contract<\/strong>.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-qu-ocurre-si-son-varios-los-transmitentes-del-elemento-en-cuesti-n\"><strong>What happens if there are several transferors of the item in question?<\/strong><\/h2>\n\n\n\n<p>The capital gain <strong>is charged on an individual basis<\/strong> proportionally to each holder, so that <strong>each transferor may choose to avail himself of this exemption<\/strong> and reinvest the amount of the transfer in a life annuity contract, as expressly stated by the Directorate General for Taxation in its Consultation V2471-18 of 9 October, which considers the case for two spouses.<\/p>\n\n\n\n<p>240,000 limit operates individually for each taxable person.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-y-si-necesito-que-la-aseguradora-anticipe-los-fondos\"><strong>What if I need the insurer to advance the funds?<\/strong><\/h2>\n\n\n\n<p>Obviously, the anticipation (total or partial) of economic rights, as would be the case with the non-fulfilment of any of the other requirements mentioned above, <strong>implies the impossibility to apply the exemption<\/strong>This will mean that tax will have to be paid on the capital gain produced at the time.<\/p>\n\n\n\n<p>In such a case, the taxpayer shall practice a&nbsp;<strong>supplementary personal income tax return<\/strong>including interest for late payment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-c-mo-se-informa-a-hacienda-de-esta-exenci-n-en-la-ganancia-patrimonial\"><strong>How is this exemption from capital gains tax reported to the tax authorities?<\/strong><\/h2>\n\n\n\n<p>Irrespective of the Administration's knowledge of the transfer of the item in question, it should be remembered that taxpayers must inform the insurance companies that market these insured annuities that it is a reinvestment of a capital gain.<\/p>\n\n\n\n<p>Well, the <strong>insurance entities must, in turn, inform the AEAT <\/strong>of this end by means of a <strong>informative statement<\/strong> which is presented in January of the following year, and where they reflect:<\/p>\n\n\n\n<ul><li>Identification of the taxable person<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul id=\"block-48a6d9b3-8b01-4d2a-9368-72b6febff770\"><li>Identify the annuity, premium paid and date of constitution.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul><li>If there is anticipation of economic rights, when such anticipation has taken
