{"id":5591,"date":"2020-10-16T07:35:27","date_gmt":"2020-10-16T05:35:27","guid":{"rendered":"https:\/\/merac.es\/?p=5591"},"modified":"2020-10-16T07:35:27","modified_gmt":"2020-10-16T05:35:27","slug":"clausula-suelo-autonomos","status":"publish","type":"post","link":"https:\/\/merac.es\/en\/clausula-suelo-autonomos\/","title":{"rendered":"Self-employed and business people will be able to claim the Floor Clause"},"content":{"rendered":"<p id=\"h-un-nuevo-pronunciamiento-jurisprudencial-abre-la-puerta-a-aut-nomos-y-empresarios-para-que-puedan-reclamar-las-cantidades-abonadas-como-consecuencia-de-la-aplicaci-n-de-las-cl-usulas-suelo-incluidas-en-sus-pr-stamos-hipotecarios\">A new jurisprudential pronouncement <strong>opens the door to freelancers and entrepreneurs<\/strong> in order that they may reclaim the amounts paid as a result of the application of the\u00a0<strong>floor clauses included in their mortgage loans.\u00a0\u00a0<\/strong><\/p>\n\n\n\n<p>Claims for the refund of amounts overpaid as a result of the imposition of so-called floor clauses in mortgage loans were being rejected in cases where the borrower was a non-consumer, i.e. when the claim was brought by self-employed, professionals or entrepreneurs.&nbsp;&nbsp;<\/p>\n\n\n\n<p>However, a recent Supreme Court ruling (168\/2020) has turned this question on its head. <strong>upholding the invalidity of the floor clause in a mortgage loan granted to a self-employed person<\/strong>The court ordered the lender to repay the sums paid in excess of the amount due.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Although each case will have to be studied to determine the viability or otherwise of the claim, we believe that this new jurisprudential pronouncement is very good news for this sector, as it opens the door for the self-employed and entrepreneurs to claim the amounts they have paid in excess as a result of the application of the floor clauses imposed in their mortgage loans.&nbsp;&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>Un nuevo pronunciamiento jurisprudencial abre la puerta a aut\u00f3nomos y empresarios para que puedan reclamar las cantidades abonadas como consecuencia de la aplicaci\u00f3n de las cl\u00e1usulas suelo incluidas en sus pr\u00e9stamos hipotecarios. <\/p>","protected":false},"author":3,"featured_media":5595,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[25,16,14],"tags":[26,28],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.6 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Aut\u00f3nomos y empresarios podr\u00e1n reclamar la Cl\u00e1usula Suelo | MERAC Legal &amp;
